War produces these at a frequency no laboratory can match. Enabled Intelligence, an American company specializing in processing data for AI training, says it has already made more than half a million hours of Ukrainian drone footage available for the next round of models, with potential uses in both military and commercial systems. This is a dramatic shift from the past, when battlefield data remained locked inside the defense world through programs like Project Maven, accessible only through classified channels for developing new weapons.

Now the loop is closing. Commercial technologies adapted for the battlefield are generating data that flows back into civilian industries. Drones trained in the signal-jammed airspace over Ukraine are being deployed in agriculture to help farmers map fields in areas lacking cell signal. This creates a new data infrastructure that governments and the private sector will rely on, but it also raises serious questions about consent and provenance. The soldiers and civilians visible in the footage did not agree to become training material for products that might be sold years later. Sensor data, camera footage, and coordinates from civilians fleeing a drone strike now inform how future machines will make decisions.

The legal framework is far behind. Existing laws regulate how militaries conduct war, but they say almost nothing about what happens when combat records are stripped of operational context, packaged as data, and licensed to companies. There is currently no agency or regulator with jurisdiction over this issue. Ukraine has begun to address access controls through its Avengers Labs program, which allows companies to train models without direct access to sensitive databases, but that mitigates only one part of the problem. The newly signed UK-Ukraine AI agreement mentions access controls, but no governments are actively working on regulating what happens when data is absorbed into a model and crosses back into civilian markets.

For executives, this is a moment to understand the new frontier of data commerce. Battlefield data is becoming a commodity, and countries like Ukraine are leading the way. But the extractive economy it creates could benefit wealthier countries far from danger while frontline states bear the mortal threat. There is also a risk that training data provenance vanishes, making it hard to trace how models absorb wartime material. Intelligence operatives scrutinize potential customers' infrastructure for ways data could reach enemies, but the provenance of AI training data is embedded in the technology itself, making tracing nearly impossible.

Governments should treat defense data like controlled weapons transfers, recording origin, licensing users, and restricting onward sharing. Until then, companies that use this data must consider the ethical and legal exposure they are taking on. The market is set to grow, and other countries are likely to follow Ukraine's lead in selling battlefield data. The responsibility for governing this new industry cannot fall solely on a country fighting for its survival; it has to be filled together by the countries and companies involved in its development. The stakes are high: errors and assumptions embedded in the data travel with the model even once it enters civilian life, from delivery vehicles to agricultural machinery.
